Key changes in regulation (EU) 2024/2865

  • EU-Based Supplier: It is now mandatory to identify an EU-based supplier on the label to ensure compliance.
    To clarify: Any substance or mixture placed on the EU market must now have a supplier established within the Union, identified on the label, who guarantees the product’s compliance with regulatory requirements. This provision aims to improve control over cross-border online sales.

  • Harmonised Classification and New Hazard Classes: Introduction of new classes such as endocrine disruptors and PBT/vPvB properties.

  • Digital Labelling: Option to provide certain information in digital format.

  • Fold-Out Labels: Regular use of fold-out labels is now permitted.

  • Refill Stations: Specific rules for the labelling and packaging of substances supplied through refill stations.

  • Advertising and Online Sales: Strengthening of mandatory information required in advertising and distance selling.

  • Advertising of Hazardous Substances: Mandatory information in the advertising of hazardous substances and mixtures is reinforced, now including hazard pictograms, warning statements, hazard statements, and additional EUH statements.

Implementation timeline for the new regulation

  • General Application: Most provisions, including new labelling rules, will apply from 1 July 2026.

  • Emergency Response Information Submission: Requirements defined in Article 45 and Annex VIII will come into force on 1 January 2027.

  • Early Application: Suppliers may voluntarily apply the new rules from 10 December 2024, providing flexibility to anticipate regulatory requirements.

  • Transitional Provisions: Substances and mixtures placed on the market before 1 July 2026 and compliant with the previous provisions may remain on the market until 1 July 2028 without reclassification or relabelling.
